Der FROHBERG – zentral wohnen, Frohbergweg 4, 3012 Bern, +41 31 306 06 76, frohberg@kathbern.ch, im Berner Länggassquartier ist eine Institution der römisch-katholischen Gesamtkirchgemeinde Bern und Umgebung, www.kathbern.ch. Mit seinen 44 möblierten Zimmern und mehreren Aufenthaltsräumen bietet er jungen Menschen in Ausbildung und/oder im Studium ein Zuhause.

Vertragsart und Vertragsdauer und Vertragsauflösung

Der Mietvertrag ist nach Art. 266e, Schweizerischen Obligationsrecht, die Miete, für ein möbliertes Zimmer abgeschlossen.
Die Mietdauer beträgt gemäss dem Zweck von FROHBERG zentral wohnen maximal die Dauer des Studiums, resp. der Ausbildung und ist auf 6 Jahre beschränkt.
Der Mietvertrag kann unter Einhaltung einer Kündigungsfrist von einem Monat auf das Ende der festen Vertragsdauer, resp. falls unbefristet abgeschlossen unter Einhaltung einer Kündigungsfrist von einem Monat auf das Ende des folgenden Monats gekündigt werden.

Mietzinsdepot

Ein Mietzinsdepot von CHF 800.— innert einer Woche nach Bestätigung der Reservation auf das UBS Konto mit IBAN: CH46 0023 5235 8449 8601 T, BIC UBSWCHZH80A von FROHBERG zentral wohnen einzuzahlen.

Monatliche Mietzinszahlung

Der Mietzins ist monatlich im Voraus bis am letzten Tag des Vormonats auf das UBS Konto mit IBAN: CH46 0023 5235 8449 8601 T, BIC UBSWCHZH80A von FROHBERG zentral wohnen geschuldet.
Es wird empfohlen für die Mietzinszahlungen bei der Bank einen Dauerauftrag zu erstellen.

Vergütungskosten

Allfällige Bankvergütungsspesen für die Gutschrift der Mietzinsen und des Mietzinsdepots sowie die Vergütung des Mietzinsdepots per Ende des Mietverhältnisses gehen zu 100 % zu Lasten des/der MieterIn.

Zahlungsrückstand

Bei Zahlungsrückstand des/der MieterIn wird eine Mahnfrist angesetzt, innert welcher der Rückstand zu bezahlen ist; zusätzliche betreibungsrechtliche Schritte bleiben vorbehalten. Mit der Mahnung kann zudem angedroht werden, dass bei Nichterfüllen der Zahlungsaufforderung das Mietverhältnis unter Einhaltung einer Frist von 30 Tagen auf das folgende Monatsende gekündigt wird (Art. 257d OR).
Für jede Mahnung wird eine Bearbeitungsgebühr von CHF 50.-- fällig.

Rücktritt vom Mietvertrag vor Mietantritt

Bei kurzfristiger Absage eines bereits unterschriebenen Mietvertrages kommen folgende Gebühren zum Tragen:

• Absagen bis zu einem Monat vor Mietbeginn:               CHF 250.--
• Absagen von 1 – 3 Monaten vor Mietbeginn:                CHF 100.--
• Absagen ab 3 Monaten und mehr vor Mietbeginn:         CHF   50.--

Zimmerwechsel und vorzeitige Auflösung

Für den Zimmerwechsel auf eigenen Wunsch wird eine Bearbeitungsgebühr von CHF 100.— verrechnet.
Rückgabe des Zimmers ohne Einhaltung der Kündigungsfrist, resp. der vereinbarten Vertragsdauer entbindet den/die MieterIn nicht von der vollen Mietzinszahlung.

Dienstleistungen, Versicherung

Im Mietpreis inbegriffen sind das Zimmer und die Nutzung der Gemeinschaftsräume. 
Monatliche wird das Zimmer durch eine externe Reinigungsfirma gereinigt. Dafür müssen die zu reinigenden Flächen frei von persönlichen Utensilien sein. Der Reinigungstag wird im Voraus bekannt gegeben.
Alle zwei Wochen wird ein neues Set Bettwäsche und zwei Sets Frottierwäsche gegen Abgabe der Schmutzwäsche zur Verfügung gestellt.
Die Effekten der Mietenden sind gegen Wasser- und Feuerschäden bis zum Höchstbetrag von CHF 1’000.— versichert, davon ausgeschlossen sind Bargeld und Schmuck.
Diebstahl ist nicht versichert, noch haftet FROHBERG zentral wohnen. 

Zimmerbezug und Zimmerabgabe

Die Ankunftszeit für den Zimmerbezug ist per E-Mail oder telefonisch mitzuteilen und erfolgt in der Regel während den Öffnungszeiten des Empfangs, Montag bis Freitag 10.00 Uhr bis 12.00 Uhr, Mittwoch 16.00 Uhr bis 19.00 Uhr. Im Falle einer Ankunft ausserhalb der Öffnungszeiten wird der Zimmerschlüssel im Schlüsseltresor deponiert und Anmeldeformalitäten werden nach Übereinkunft nachgeholt.
Nach Mietende muss das Zimmer spätestens bis 10.00 Uhr des letzten Werktags vor Monatsende abgegeben werden, falls nicht möglich nach Übereinkunft an den letzten drei Vortagen.
Die Kaution wird nach Mietende und erfolgter Abgabe zurückbezahlt, sofern das Zimmer in ordentlichem Zustand abgegeben und alle Mieten bezahlt sind. Kosten für die Erledigung von Schäden sowie allfälligen Bankgebühren werden mit der Rückzahlung verrechnet.
Bei Mietbeginn sowie beim Mietende wird ein Übergabeprotokoll verfasst, das von beiden Vertragsparteien unterschrieben wird.

Einwohnerkontrolle, Meldepflicht

Die Mietenden haben sich bei der Gemeinde, Einwohnerdienst der Stadt Bern, über die Meldepflicht zu informieren.
Schweizerbürger haben die Pflicht, sich innert spätestens 14 Tagen beim Einwohnerdienst anzumelden, respektive umzumelden.
Ausländische Mietende in der Regel ab einem Aufenthalt von mehr als 90 Tagen.

Hausordnung

Die Hausordnung bildet einen integrierenden Bestandteil zum Mietvertrag zusammen mit den Bestimmungen des Schweizerischen Mietrechts. 
Nicht Einhalten der Hausordnung hat eine Verwarnung zur Folge. Bei schweren und wiederholten Zuwiderhandlungen behält sich die Betriebskommission die fristlose Kündigung vor. Der/die MieterIn haftet für den Mietausfall und allfällige Schäden und Kosten bis zum vertraglichen Endtermin.

Gültigkeit der Allgemeine Geschäftsbedingungen (AGB)

FROHBERG zentral wohnen behält sich vor die Allgemeine Geschäftsbedingungen (AGB)
ohne Vorankündigung anzupassen. Änderungen werden am Anschlagsbrett beim Empfang publiziert und gelten ab Veröffentlichung.

FROHBERG – zentral wohnen, Frohbergweg 4, 3012 Bern, +41 31 306 06 76, frohberg@kathbern.ch, in the Länggass district of Bern is an institution of the Roman Catholic Church in Bern and the surrounding area, www.kathbern.ch. With its 44 furnished rooms and several common rooms, it offers young people a home while they are training and/or studying.

Type, duration and termination of contract

The rental contract is for a furnished room in accordance with Art. 266e of the Swiss Code of Obligations.
In accordance with the purpose of FROHBERG, the rental period for centrally located accommodation is limited to the duration of the studies or training and is restricted to a maximum of six years.
The rental contract can be terminated by observing a notice period of one month to the end of the fixed contract period or, if concluded for an indefinite period, by observing a notice period of one month to the end of the following month.
 

Rent deposit

A rental deposit of CHF 800.- is to be paid within one week of confirmation of the reservation to the UBS account with IBAN: CH46 0023 5235 8449 8601 T, BIC UBSWCHZH80A of FROHBERG zentral wohnen.

Monthly rent payment

The rent is due monthly in advance, by the last day of the previous month, to the UBS account with IBAN: CH46 0023 5235 8449 8601 T, BIC UBSWCHZH80A, in the name of FROHBERG zentral wohnen.
It is recommended to set up a standing order with the bank for the rental payments.

Remuneration costs

Any bank charges for crediting the rent and the rent deposit, as well as the repayment of the rent deposit at the end of the tenancy shall be borne in full by the tenant.

Arrears

If the tenant falls into arrears, a payment period will be set within which the arrears must be paid; the right to take additional legal action is reserved. The reminder may also include a warning that if the request for payment is not met, the tenancy will be terminated at the end of the following month, subject to a notice period of 30 days (Art. 257d OR).
A processing fee of CHF 50.- is due for each reminder.

 

Withdrawal from the rental contract before the start of the rental period

The following fees apply to short-term cancellations of a signed rental contract:

• Cancellation up to one MTh before the start of the rental period:           CHF 250.-
• Cancellation 1–3 MThs before the start of the rental period:                 CHF 100.-
• Cancellation made 3 MThs or more before the start of the rental period: CHF  50.-

Changing rooms and early termination

A processing fee of CHF 100.- will be charged for changing rooms at your own request.
Returning the room without observing the notice period or the agreed contract duration does not release the tenant from the full rental payment.

Services, insurance

The rent includes the room and use of the communal rooms.
The room is cleaned monthly by an external cleaning company. To facilitate this, the surfaces to be cleaned must be kept free of personal items. The cleaning day will be announced in advance.
A new set of bed linen and two sets of towels will be provided every two weeks in return for the dirty linen.
The tenants' belongings are insured against water and fire damage up to a maximum amount of CHF 1’000.-, excluding cash and jewellery.
Theft is not insured, nor is FROHBERG – zentral wohnen liable.

Room occupancy and handover

The time of arrival for occupying the room is to be communicated by email or telephone and will normally be during the opening hours of the reception, Monday to Friday 10.00 am to 12.00 noon, Wednesday 4.00 pm to 7.00 pm. If you arrive outside opening hours, your room key will be placed in the key safe and you will complete the registration formalities at a time to be agreed.
At the end of the rental period, the room must be vacated by 10:00 a.m. on the last working day before the end of the month at the latest; if this is not possible, by 10:00 a.m. on the last three days before the end of the month, to be agreed.
The deposit will be refunded after the end of the tenancy and after the room has been handed over, provided that the room is in good condition and all rents have been paid. Costs for damage repairs and any bank charges will be deducted from the repayment.
At the beginning and end of the tenancy, a handover protocol will be drawn up and signed by both parties.

Residents' registration requirements

Tenants must find out about their registration requirements from the City of Bern's Residents‘ Registration Office. Swiss citizens must register or re-register with the Residents’ Registration Office within 14 days.
Foreign tenants must register or re-register as a rule if they are staying for more than 90 days.

House rules

The house rules form an integral part of the tenancy agreement together with the provisions of Swiss tenancy law.
Failure to comply with the house rules will result in a warning. In the event of serious and repeated violations, the operating commission reserves the right to terminate the contract without notice. The tenant is liable for the loss of rent and any damage and costs until the contractual end date.
 

Validity of the General Terms and Conditions (GTC)

FROHBERG –zentral wohnen reserves the right to amend the General Terms and Conditions (GTC) without prior notice. Amendments will be posted on the bulletin board at reception and will be effective immediately.
